I experience this issue a lot. As an artist and gallery owner, I am asked to donate my own work, work of the artists I represent, or to directly ask the artist to donate. My response to the asker is,
“I’d be happy to donate work to your cause (or organization), however I cannot do so until Congress changes the law on such donations. Currently artists are only able to deduct the cost of materials. If you have a patron who would like to purchase the work and then in turn donate it, I’d be happy to help you with that. This way, everyone is able to take full advantage of the current process. The artist gets paid for the value of their work, the collector is able to receive a tax deduction, and your organization will most likely receive a larger sum for the work.”
This response usually educates the person asking. Most of them do not know that the artist is allowed to write off only the cost of materials. They asker usually touts the benefits of donating – such as the tax write-off (false) and the potential to reach new patrons. While the potential is definitely there – most of the donating artists I know hardly ever reap the financial reward of the donation.
Also, I find that there is a trend of budget-savvy art collectors who now know they can find art “steals” at charity events. These collectors are no longer going to galleries or artists to purchase work; they wait for the silent auction and get a piece for 1/3 of its value. Please consider this when donating your work. I admit – I’ve done it myself! Donate to causes you believe in and support wholeheartedly.

I deal with this often as a visual artist.
I have donated many paintings to charity events and auctions over the years and I still do, to those I truly believe in. However, it is most always at a financial loss to me personally. I have had to curtail my charitable giving severely due to only being able to claim costs of materials. This is a true shame.

I echo dede and Megan. Everyone take just a few moments to sign the petition. I still donate a couple of paintings a year to my favorite charities, but I can’t afford to answer every request and I know most others can’t either.
